Terms of Service

These Terms of Service (“Terms”) constitute a legally binding agreement between you and T1D Scout Screening Service (“T1D Scout,” “we,” “us,” or “our”). These Terms govern your access to and use of our website, mobile application, screening kits, laboratory services, and all related products or services (collectively, the “Services”).

PLEASE READ THESE TERMS CAREFULLY. BY ACCESSING OR USING THE SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS AND OUR PRIVACY POLICY.

If you do not agree to these Terms, do not access or use the Services.

1. Acceptance of Terms; Changes to These Terms

1.1 Binding Agreement

By purchasing a screening kit, creating an account, submitting a biological sample, or otherwise using the Services, you agree to be legally bound by these Terms

1.2 Modifications

We may modify these Terms at any time. If we make material changes, we will notify you via email or through the Services. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

1.3 Supplemental Terms

Certain components of the Services—such as telehealth consultations, autoantibody laboratory testing, or genetic analysis—may require your acceptance of additional terms, informed consent documents, or agreements with third-party providers.

2. The “No Medical Advice” Disclaimer

2.1 Information Only

The Services are intended for informational, educational, and risk-assessment purposes only. T1D SCOUT IS NOT A HEALTHCARE PROVIDER AND DOES NOT PRACTICE MEDICINE.

2.2 Not a Diagnosis

The Services may provide results such as “Detected,” “Positive,” “Not Detected,” “Inconclusive,” “High Risk,” or similar classifications.

Such results are NOT a diagnosis of Stage 3 Type 1 Diabetes or any medical condition.

2.3 No Clinical Action Without a Medical Professional

You agree not to make changes to medications, diet, health behaviors, or medical care without consulting a licensed physician.

2.4 Emergency Situations

If you believe you or your child may be experiencing symptoms of diabetes (e.g., excessive thirst, frequent urination, weight loss, vomiting), seek emergency medical care immediately.

3. Eligibility; Accounts; Minors

3.1 Eligibility

You must be at least 18 years old to open an account or purchase a test.

3.2 Minors

If you order a test for a minor, you represent and warrant that:

  • You are the parent or legal guardian,
  • You have the legal authority to consent to the minor’s screening,
  • You accept the Informed Consent and these Terms on the minor’s behalf,
  • You will supervise the minor’s use of the Services.

3.3 Account Security

You agree to maintain the confidentiality of your login credentials. You are responsible for all activity occurring under your account.

4. Collection, Use, and Processing of Biological Samples

4.1 Sample Submission

By submitting a saliva or blood specimen (or other biological material), you authorize:

  • Collection and processing of the sample,
  • Laboratory analysis by CLIA-certified and CAP-accredited partners,
  • Reporting of screening results to you through your secure account.

4.2 Secondary Use

As described in our Privacy Policy, you grant T1D Scout a license to de-identify your data for research, algorithm development, and publication.

4.3 Sample Retention and Destruction

Your sample may be stored for quality assurance, replication testing, regulatory compliance, or future test development unless you request destruction (where permitted by law).

5. Intellectual Property; User Content

5.1 Ownership

All content, design, software, text, graphics, logos, and analytical methods used in the Services are the exclusive property of T1D Scout and protected by U.S. and international intellectual property laws.

Your personal biological data remains your property; however, the analysis, interpretation, risk score, and report format are proprietary to T1D Scout.

5.2 User Content

Any content you submit (e.g., feedback, suggestions, uploaded forms) may be used by T1D Scout without restriction. You grant us a perpetual, irrevocable, royalty-free, worldwide license to use such feedback for any purpose.

5.3 Restrictions

You agree not to:

  • Reverse engineer or copy the Services,
  • Use the Services for commercial purposes,
  • Reproduce risk score algorithms or report templates,
  • Attempt unauthorized access to T1D Scout systems.

6. Payment, Shipping, and Refunds

6.1 Payment

You agree to pay all fees associated with the Services. Prices are subject to change at any time.

6.2 Refunds

Refund requests will be evaluated according to T1D Scout’s refund policy. Refunds are not available after your sample has been received by the laboratory.

6.3 Shipping

You are responsible for providing accurate shipping information. Replacement fees may apply for lost or damaged kits.

7. Risks, Limitations, and Accuracy of Screening

7.1 Analytical Limitations

All testing carries inherent risks of false positives and false negatives.

7.2 No Warranted Accuracy

While we use high-quality CLIA/CAP laboratories, we do not warrant that:

  • Your sample will produce a valid result,
  • Results will be error-free,
  • Laboratory turnaround times will be guaranteed.

7.3 Technology Updates

Interpretations may evolve as new scientific knowledge emerges. Your report reflects the state of science at the time of processing.

8. Third-Party Services

T1D Scout may use third-party laboratories, sequencing centers, telehealth providers, insurers, or shipping vendors.

We are not responsible for the acts or omissions of these third parties.

9. Privacy and Data Protection

Your use of the Services is governed by our Privacy Policy, which explains how we collect, store, use, and disclose your personal information and biological data.

By using the Services, you acknowledge that you have reviewed and accepted the Privacy Policy.

10. Termination

We may suspend or terminate your account if:

  • You violate these Terms,
  • You misuse the Services,
  • We discontinue offering the Services.

You may delete your account at any time; however, clinical records and PHI are retained for legally required durations.

11. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

T1D SCOUT DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY,
  • FITNESS FOR A PARTICULAR PURPOSE,
  • NON-INFRINGEMENT,
  • ACCURACY OR RELIABILITY OF RESULTS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

12.1 Liability Cap

T1D Scout’s total liability arising out of or relating to the Services shall not exceed the amount you paid for the Services.

12.2 No Indirect Damages

T1D Scout shall not be liable for any indirect, punitive, special, exemplary, consequential, or incidental damages, including:

  • Loss of profits,
  • Loss of data,
  • Emotional distress,
  • Medical costs.

13. Indemnification

You agree to indemnify, defend, and hold harmless T1D Scout and its employees, officers, directors, contractors, and partners from any claim arising out of:

  • Your misuse of the Services,
  • Your violation of these Terms,
  • Your failure to seek appropriate medical care.

14. Mandatory Arbitration; Class Action Waiver

14.1 Arbitration

Any dispute arising out of or relating to the Services shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

14.2 Waiver of Jury Trial

YOU WAIVE YOUR RIGHT TO A TRIAL BY JURY.

14.3 Class Action Waiver

YOU MAY ONLY BRING CLAIMS IN YOUR INDIVIDUAL CAPACITY AND NOT AS PART OF A CLASS OR COLLECTIVE ACTION.

14.4 Opt-Out

You may opt out of arbitration within 30 days of first using the Services by sending written notice to:

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict-of-law principles.

16. Miscellaneous

16.1 Severability

If any provision is deemed invalid, the remaining provisions will remain in effect.

16.2 Entire Agreement

These Terms, together with the Privacy Policy and Informed Consent, constitute the entire agreement between you and T1D Scout.
